1. Introduction and Acceptance
These Terms and Conditions govern your access to and use of riskpe.com and all services offered by Ryzpe Consulting Pvt Ltd, operating under the brand name RiskPe (RiskPe, we, us, or our), with its registered office at 102, Scheme No. 25, Shiv Nagar II, Murlipura, Jaipur, Rajasthan 302039, India. By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree, please discontinue use of the website and services immediately.
2. Nature of Our Services
RiskPe is an independent, fee based insurance advisory platform. We provide policy health checks, insurance portfolio reviews, claim recovery consultancy, and access to empanelled insurance advisors for the purchase of insurance products. RiskPe is not an insurance company and does not underwrite, issue, or guarantee any insurance policy. Where you choose to purchase insurance through our empanelled advisors, the resulting insurance contract is solely between you and the relevant insurer, subject to that insurer's own terms, conditions, and policy wording.
3. What Our Services Are Not
RiskPe does not guarantee the outcome of any insurance claim, claim recovery effort, or policy recommendation. Our advisory services represent professional opinion and analysis based on the information you provide and publicly available or insurer disclosed information at the time of review. We do not guarantee that any claim we review or pursue on your behalf will be approved, partially approved, or approved within any particular timeframe, as final claim decisions rest solely with the relevant insurer, the Insurance Ombudsman, or applicable regulatory authority. RiskPe is not a law firm and does not provide legal advice, where legal representation becomes necessary, we may refer you to independent legal counsel at your own cost.
4. Eligibility
Our services are available only to individuals who are at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872, and to duly authorized representatives of corporate entities.
5. Fees and Charges
Our current fee structure for advisory plans and claim review services is published at riskpe.com/pricing and may be updated from time to time. Fees for advisory services are charged independently of any insurance premium and are not linked to, contingent upon, or influenced by which insurer or policy you ultimately choose, consistent with our fee based, non commission driven model. Specific fee arrangements for claim recovery services, including circumstances where fees apply only upon successful pursuit of a claim, are set out in our Refund and Cancellation Policy at riskpe.com/refund-policy and shall be read as part of these Terms.
6. Payment Processing
All online payments made through this website are processed by Razorpay, a third party, RBI authorized payment gateway. RiskPe does not collect, store, transmit, or have access to your card, net banking, UPI, or other payment instrument details at any point, all such information is handled exclusively by Razorpay in accordance with its own security standards and applicable Reserve Bank of India regulations.
7. Your Responsibilities
You agree to provide accurate, current, and complete information when using our services, including but not limited to policy documents, claim related documents, and personal or financial information necessary for our review. You acknowledge that the quality and accuracy of our advice depends materially on the accuracy and completeness of the information you provide, and RiskPe shall not be liable for any outcome arising from incomplete, inaccurate, or misleading information supplied by you.
8. Intellectual Property
All content on riskpe.com, including text, graphics, logos, tools such as the Human Life Value calculator, and underlying software, is the property of Ryzpe Consulting Pvt Ltd or its licensors and is protected under applicable Indian intellectual property law. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted under applicable Indian law, RiskPe's total liability arising out of or relating to our advisory services, whether in contract, tort, or otherwise, shall not exceed the total fees actually paid by you to RiskPe for the specific service giving rise to the claim in the twelve months preceding the event. RiskPe shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profit, loss of an insurance claim amount, or loss of opportunity, even where we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be lawfully limited or excluded under Indian law, including in cases of proven gross negligence or willful misconduct.
10. Indemnification
You agree to indemnify and hold RiskPe, its directors, employees, and empanelled advisors harmless from any claim, loss, or demand arising from your breach of these Terms, your violation of any law, or your provision of inaccurate or misleading information.
11. Termination
RiskPe reserves the right to suspend or terminate access to our services at our discretion, including where we reasonably believe these Terms have been violated, without prejudice to any fees already earned for services rendered.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or our services shall first be attempted to be resolved amicably through good faith discussion. Failing amicable resolution within thirty days, the dispute shall be subject to the exclusive jurisdiction of the competent courts at Jaipur, Rajasthan, India.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date, and continued use of our services after such changes constitutes acceptance of the revised Terms.
